Why do these ebay auctions say this? (selling windows)?

why is this?
This is because this piece of software is OEM. This means it is not a retail version, and so should only be sold with hardware- basically it should only really be sold with a PC.
But a loophole means that if they send any peace of hardware - something that works on a pc then it is legal. Its simply a way of getting around the policies for this software type given by microsoft.
